The family of Graham Longmate - whose neighbour erected a wooden fence outside of his house in Wisbech – say that the road is ‘included in everyone’s deeds’.

The dispute has led to a massive fall-out among residents of Kestrel Drive in recent weeks.

The fence was put up by Mark Atkins who claims it is the only effective remedy to stop his driveway from being blocked by visiting cars.

Anna Longmate, Graham’s daughter, responded to a statement Mr Atkins sent to our editor last week.

She said:“My dad retired and moved into the property he used to rent out. The property was always rented to hard working genuine families, there were never issues with the tenant as contact details were available if there was ever a problem.

“They [Mr and Mrs Atkins] claimed the road was theirs for the last 20 years, until my dad proved them wrong last month.

“The private road was sold off by Reason Homes to be maintained by all the residents. They all own the road.

“However on the title deeds there is a section in red outlining the entrance to each individual property, the road is included in everyone’s deeds, however that does not mean you own that section of road, it just depicts access to their driveways.

“The covenant states everyone’s role within the private road. That does not include causing damage by erecting any fence.”

Mr Atkins said that he decided to erect a trellis on my drive to “make it clearly obvious that if you park there, you will cause an obstruction.”

Reason Homes, who are the property developers, say they are aware of the situation and working to resolve it.
